Member State competent for examining and deciding on visa applications

Visa applications must be requested at the consular post competent for examining and deciding visa applications, according to the Visa Code.

The Member State competent for examining and deciding on an application for a uniform visa must be:

  • The Member State whose territory constitutes the sole destination(s) visit(s);
  • If you visit more than one destination, the Member State whose territory constitutes the main destination with regard to the duration and purpose of stay;
  • If it can be determined the main destination, the Member State whose external border the applicant intends to enter first.

The Member State competent for examining and deciding on an application for a uniform visa for transit should be:

  • In case of transit of a single Member State, that State;
  • Where several Member States, the Member State whose external border the applicant intends to cross to start the transit.

The Member State competent for examining and deciding on an application for an airport transit visa should be:

  • In case of only one scale, the Member State in which the airport is located;
  • In case of more than one airport transit (different airports during the journey to and return), the Member State in which the airport is located of first entry.
